The Assistant Inspector General of Police, Zone One Headquarters, Kano, has refuted claims made in a recent report titled “Police Disregards Court Restraining Order, Invited Judge in Kano.” The police insist that the report is misleading and seek to clarify the facts surrounding the ongoing investigation.
According to the police, the case originated from a petition submitted on March 6, 2025, by Alhaji Abdullahi Ibrahim Sharada of Sharada Quarters, Kano. The petitioner accused Alhaji Dayyabu Umar and three others of criminal conspiracy, cheating, and misappropriation involving the sum of Fifty Million Naira (N50,000,000.00). He alleged that he was deceived into paying the amount for a fictitious property and, upon realizing the fraud, unsuccessfully sought a refund before reporting the matter to the police.
Investigation Uncovers Financial Irregularities
During the investigation, detectives traced Forty Million Naira (N40,000,000.00) to a Zenith Bank account (1012679910) registered under the Sharia Court Department Deposit Account. The remaining Ten Million Naira (N10,000,000.00) was linked to two other bank accounts. A receipt for the entire Fifty Million Naira transaction was issued by an entity unrelated to the court, raising suspicions of fraud.

Further findings revealed that the suspects falsely presented themselves as sellers of a property belonging to the heirs of the late Abdulsalam Abdullahi, allegedly using the Upper Sharia Court, Kasuwa, as a front. However, the said property had already been awarded to different parties under a consent judgment issued by the Kano State High Court on February 22, 2024, in Suit No. K/592/2023.
Court Officials Implicated
The investigation also uncovered the involvement of the Registrar of the Upper Sharia Court, Kasuwa, who admitted to collecting the funds under the instruction of Judge Alkali Abdu Abdullahi Waiya. The Registrar claimed he was unaware of any pending civil case concerning the property. Given the use of an official court account in an alleged fraud, the police invited all relevant parties, including the judge, through the appropriate authority—the Kano State Sharia Court of Appeal.
Police Maintain Investigation Is Criminal, Not Civil
The police strongly refuted claims that they ignored a court restraining order, clarifying that the investigation strictly concerns criminal offenses, not a civil dispute. They emphasized that only Federal or State High Courts have the constitutional authority to issue restraining orders against law enforcement in matters of fundamental rights, as stipulated in Section 46 of the 1999 Constitution (as amended). Furthermore, the Nigeria Police Force was not a party to any restraining order referenced in the misleading report.
